I am admittedly not a federal courts expert and I bow to Prof. Vladeck's vastly superior knowledge, but I wonder why write a letter rather than move to file a supplemental pleading or something similar? For those who know far better than I, is the Clerk under any obligation to pass this letter along to the panel, as requested by Prof. Vladeck?
