OK, so, "we have always done it so we need to think about updating it" is a non sequitur? Then, so is: "we have always done it so therefore we don't need to change."

Large parts of our system of government, and certainly of our legal system, were inherited from pre-revolutionary-war Britain. Similarly, though less directly, these systems were influenced by Rome.

Yeah, weird argument. When you read the story, it sounds like a case that would be difficult to prosecute and probably shouldn’t go to trial. The issue is that it’s the Commander who makes the decision. It’s just unseemly and undermines trust in Commanders. It’s as true for other serious crimes as it is for sex assaults.

As is often the case, there are not enough facts to tell wether the case highlighted had prosecutorial merit or not. But your point that a commander making that decision subjects the decision to increased scrutiny, and perhaps increased skepticism, is certainly valid.

A military accused’s unsworn statement comes from our British military legal heritage. Should we ditch it bc King George III apparently was cool with it? Not everything that is old is bad, sometimes it is old bc it’s functional and valuable.

These responses seem very sophistic to me. He was obviously saying old AND bad. The latter part is implied in "archaic"--old and no longer fitting in with modern standards or sensibilities.

Well done using a reference to Ancient Greece in a comment stream about whether roots in Ancient Rome make a system outdated. I’m assuming that was intentional and I appreciated it. Comments are closed.
