Well, since Al Qosi is in combat, at least presumably, perhaps his lawyer is thinking that Al Qosi's untimely demise would result in the case being abated. So keep the appeals going.

That looks to me like a polite invitation for trial courts to exercise their initiative under FRCP 11(c)(3).
